Cost effective and high quality family work
Fixed Fee Uncontested Divorce:
Our fixed fees for an uncontested divorce amount to £1,045. This is inclusive of our firm’s fees of £550 plus vat currently at 20% which equals £660 and court fees of £385 for issuing the petition and for the application for Decree Absolute. The fixed fee uncontested divorce includes all the steps in the process, from taking your initial instructions to obtaining Decree Absolute. However, you may be liable for further court fees, for example, if your petition requires amending etc. If your divorce becomes contested, for instance, if your spouse defends the divorce, we will then have the right to charge additional sums at the respective fee earner's rate.
What is included?
- Taking your instructions at the first meeting;
- Advising you, exploring your options and explaining what information and documents you will need to provide;
- Correspondence with you regarding the divorce process;
- Correspondence with the court, your spouse and their solicitor;
- Preparation of all necessary documents, for example, divorce petition, statement of arrangements for children etc and filing the same at court;
What is excluded?
- In the event that your divorce petition requires amendment after it has been issued, you will be charged accordingly for our time spent and there will be an additional court fee;
- Any costs for swearing affidavits. This usually costs approximately £5 plus an extra £2 for each exhibit. Alternatively the local county courts will swear affidavits free of charge;
- In the event your spouse decides to defend the divorce, file an answer and cross-petition, you will be informed and will be charged at the respective fee earner’s hourly rate;
- Any cost in relation to having the marriage certificate translated for court purposes will be in addition to the fixed fee. You will be informed if this is required and payment will be required on account.
- If your spouse does not acknowledge receipt of the divorce petition it may be necessary to instruct a process sever to serve the papers on your spouse directly. The cost of the process server will be in addition to our fixed fee rate;
- Where there is a dispute of costs, the costs of preparing a statement for you or for your legal representative to attend court for you will be in addition to the fixed fee rate;
- Advice or proceedings in relation to wills, property, finances, pensions or children is charged at the respective solicitors’ hourly rate;
- Enforcement of any costs order. This will be charge at the respective solicitors hourly rate.
- Fixed fee is not applicable where you or your spouse is a resident outside the UK;
- If you decided to stop the divorce prior to issuing the petition you will be charged for the work undertaken so far on the respective fee earner’s rate..
When are the costs payable?
Our costs are payable in two payments; the first half £522.50 prior to the issuing of the divorce petition. The second half of £522.50 needs to be paid the following month.Financial Remedies
There are two parts to divorce, the divorce itself as outlined above and, the financial aspects. If you require this firm to carry out work in relation to your finances, your file will be passed to Patricia Hogg. All work in relation to the division of finances will be billed at her hourly rate.Getting Started
